Terms of Service
The agreement between Braxion and the businesses that use Braxion Connect.
Interim terms, under legal review. We'll post any revised version here with a new effective date.
Effective date: October 24, 2026
These Terms of Service ("Terms") govern your use of the Braxion website and of Braxion Connect (the "Service"), provided by Braxion Connect (a business operated by Hunter Wilson) ("Braxion," "we," "us"). By signing up for or using the Service, the business you represent ("Customer," "you") agrees to these Terms.
1. The Service
Braxion Connect is designed to answer missed calls to your business line with a greeting in your business name, offers callers the option to press 1 to receive texts, sends texts only to callers who request them, sorts requests by urgency using automated tools including AI, and alerts you by email. The Service is in prelaunch; features become available when your service is activated and may change as the Service develops.
2. Plan, billing and cancellation
- Braxion Connect Pro is $199 per month, billed by automatic card payment processed by Stripe.
- Your first subscription charge occurs when your service is ready for activation, not during onboarding or while carrier (A2P 10DLC) approval is pending.
- Your subscription then renews automatically every month on the same billing date until cancelled. By subscribing, you authorize us to charge your payment method for these recurring monthly payments.
- You can update your payment method at any time through our secure billing portal.
- Setup fee: the setup fee is waived for our first five paying clients and will never be charged to them retroactively. Starting with paying client #6, a $99 setup fee applies as a separate one-time charge agreed before onboarding.
- Cancellation and refunds: You can cancel anytime, without advance notice, through our secure billing portal or by contacting support at hello@braxionconnect.com. Cancellation takes effect at the end of your current paid billing period, and you won't be charged again. Monthly payments are generally nonrefundable, except where required by law or otherwise agreed in writing.
- Carrier, registration and messaging costs: Normal Twilio, carrier, A2P 10DLC registration and campaign, phone number, and messaging costs are included in your $199/month Pro subscription. For our first five paying clients, setup is free, including the normal initial registration costs, which Braxion covers. Starting with paying client #6, the $99 one-time setup fee covers standard onboarding and initial registration costs. Billing is predictable each month, with no surprise fees.
- Usage and extra numbers: Any usage limits for your plan will be stated in your order or plan details. If your usage becomes unusually high or you request additional phone numbers, Braxion will review this with you first. Any additional charges or plan adjustments take effect only after you agree to them in writing.
3. Your responsibilities
- Provide accurate business information, including what is needed for text-messaging (A2P 10DLC) registration.
- Use the Service only for responding to your customers' service requests, not for marketing texts unless separately agreed and lawfully consented.
- Follow applicable laws, including the TCPA and carrier rules, and do not ask us to text anyone who has not requested it.
- Call back customers who request it; the Service does not perform your services or guarantee responses.
4. Text messaging
Text messages are sent only as described on our SMS Consent page and under our SMS Terms. Recipients can reply STOP to opt out or HELP for help at any time. Texts are sent from a toll-free number verified with U.S. carriers (or, where applicable, a number registered for A2P 10DLC). Delivery depends on carriers and isn't guaranteed.
5. AI and automated triage
Urgency labels are automated suggestions and can be wrong. You remain responsible for deciding which customers to call and when.
6. Data and privacy
We handle information as described in our Privacy Policy.
- Your data. You own your business information and your customers' information that passes through the Service, such as caller phone numbers, messages, and lead records ("Customer Data").
- How we use it. We process Customer Data only to provide, secure, support, and improve the Service for you, and as required by law. We don't sell Customer Data or use it for anyone's marketing.
- Service providers. We use trusted providers to run the Service, currently Twilio (calls and texts), Make (automation), OpenAI (urgency classification), Google (email and lead tracker), and Cloudflare (website and email routing). They process Customer Data only as needed to provide their services to us. We'll update this list if it changes.
- When you leave. After cancellation, you can ask for an export of your lead records within 30 days. We then delete or de-identify Customer Data within a reasonable time, except records we must keep, such as consent and opt-out records.
7. Availability
The Service relies on third-party telephone, messaging, automation, email and AI providers. We do not guarantee uninterrupted or error-free operation, delivery of any call, text or email, or any business result.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee any number of recovered calls, jobs, or revenue. Braxion Connect is not an emergency service and does not dispatch help; callers with emergencies should contact you directly or call 911.
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business. Braxion's total liability for any claim relating to the Service is limited to the fees you paid us in the three months before the event giving rise to the claim.
9. Indemnification
You agree to defend and indemnify Braxion against third-party claims arising from your business information, your instructions to us, or your use of the Service in violation of these Terms or the law. Braxion agrees to defend and indemnify you against third-party claims arising from our breach of these Terms or our violation of the law in providing the Service. The party seeking indemnification must give prompt notice and reasonable cooperation.
10. Governing law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Utah.
11. Changes
We may update these Terms by posting a new version here with a new effective date. For material changes, we'll email you at least 30 days before they take effect. If you don't agree, you can cancel before the change takes effect.
